Types of Workers’ Comp Benefits in Kentucky
Workers who are injured on the job are entitled to compensation. Kentucky requires employers to carry workers’ compensation insurance for this reason. If you have suffered an injury, you must notify your employer immediately and begin the process of pursuing a settlement.
Workers who are injured may need to take time off work. This would cause them to potentially lose a portion of their wages. They have the option of using their accumulated paid time off to cover a few days of missed work. However, they would not be able to use both their accumulated leave and their income benefits from workers’ compensation at the same time. If they don’t have enough accumulated leave, or they choose to use workers’ compensation income benefits instead, they may receive an amount that is 2/3 of their regular rate of pay, up to the state maximum regulated by the Department of Workers’ Claims.
Medical expenses are covered under workers’ compensation insurance, as long as they are necessary and reasonable. By law, employees do not have to pay co-pays for medical treatment of work-related injuries. The employer is required to pay for the treatment, cure, and relief of an occupational disease or injury, as well as any disability required later on. It is important to note that, unlike regular personal injury benefits, workers’ compensation benefits do not cover pain and suffering or other noneconomic damages.
There Are 3 Types of Disability Benefits for Workers’ Compensation
Depending on your situation, you may be able to receive temporary total disability, permanent partial disability, or permanent total disability benefits. Temporary total disability relates to situations where the injured worker cannot return to any type of work for a period of time. However, the period of time must be at least 7 days. If the injured employee misses 8 days or more of work, he or she will be able to get temporary total disability for each day of missed work. However, if the employee misses more than 15 days, the insurance will pay for the original 7 days of missed work as well.
Permanent partial disability is paid to workers who suffer permanent injuries that prevent them from completing certain types of work. However, they may return to their job in a modified position. Thus, they are able to earn some wages, but will be permanently disabled.
Likewise, permanent total disability is paid to employees suffering from permanent physical effects of their injury. However, they will never be able to return to any type of work. The physician must give a permanent disability rating, and the insurance company will provide disability benefits for lost income.
